Charter Terms & Conditions
BAGGAGE: Flagship Trailways does not assume any responsibility for the handling or maintenance of any baggage, parcels, or other property. Baggage and all other personal property will be handled only at passengers’ own risk. Passengers’ baggage shall be carried subject to the available accommodations, provided by interior and/or exterior racks.
CANCELLATIONS: A deposit, as listed on your charter confirmation, is due within ten days of receiving the contract. Failure to send the deposit may result in a cancellation of the charter. The deposit is fully refundable if your coach is canceled 31 days in advance of your trip. Cancellations are subject to a cancellation fee calculated as a percentage of the total cost of transportation services based on the number of days prior to the date of the charter trip:
- 15-30 days: 30% cancellation fee
- 14-8 days: 50% cancellation fee
- 7-0 days: 100% cancellation fee
Payment in full is due for cancellations made within 24 hours of the date of your trip. Please note that a change in the date of your trip may result in additional fees.
DAMAGE: The cost of repairing damage to buses resulting from acts of members of the chartering party shall be charged to the chartering party and is payable as soon as such cost is determined.
DISCLAIMER: Flagship Trailways is not liable for damage to or loss of baggage or other property. Baggage and all other property will be handled at the passenger’s risk and only in an amount that can be conveniently carried in the storage areas of the charter coach. The carrier will charge any damage to the coach by the charter party to the responsible party.
EQUIPMENT: If for some reason beyond the control of the company, a mechanical failure makes necessary, the replacement bus may be of a different type. In no case shall the company be liable for any damages or inconvenience resulting from mechanical failure or delay; the company cannot guarantee the availability or operation of video equipment. Flagship Trailways reserves the right to use leased equipment.
Flagship Trailways will not be liable for delays caused by acts of God, natural disasters, national, state or local emergency, acts of war or terrorism, authority of law, quarantine, riots, strikes, breakdowns, bad road conditions, snowstorms, and other conditions beyond our control, and does not guarantee to arrive at or depart from any point at a specified time. We accept no responsibility for any losses, damages, inconvenience or additional expense due to any or all of the above.
FEDERAL REGULATIONS: The Department of Transportation, Bureau of Motor Carrier Safety, has adopted certain regulations for the protection and safety of both the customer and the driver. Drivers are limited to:
1) Fifteen (15) consecutive hours on duty in any one-day.
2) Of these fifteen (15) hours, a maximum of ten (10) hours may be actual driving hours.
3) Upon reaching a destination and the driver’s total driving hours have been used, the driver must have a minimum of eight (8) hours off duty before local service may be performed or to begin an extended period of driving.
PASSENGERS: Flagship Trailways reserves the right to refuse to transport persons under the influence of intoxicating liquor and/or drugs, or any person incapable of taking care of themselves, or whose conduct is such, or is likely to become such as to be objectionable to other persons and/or interfere with the safe operation of the bus. Passengers shall not interfere with the bus driver in the discharge of his/her duty, nor tamper with any apparatus, appliance, or equipment on the bus. In the case of youth groups, an adequate number of chaperones must be aboard, and seating in such a fashion so as to monitor and control the behavior of the youths. Homeland security regulations governing passenger conduct and company operations are in effect.
PROHIBITED ITEMS: The following items and activities are prohibited without the consent of the company: decorations, drugs, alcohol, smoking, glass containers, weapons, explosives, firearms, fireworks, hazardous materials and ammunition. Animals are not allowed on Flagship Trailways buses, except service animals according to law.
RATES/PAYMENT: The charges for your charter bus are based on the original information. When, at the request of the chartering party, any change in itinerary or service resulting in increase in miles or hours over that specified in the charter order given, an additional charge shall apply to all such additional service and can usually be accommodated by having the driver call the dispatcher for an adjusted price. Rates subject to change, and an additional fuel surcharge may apply, under the following conditions: a) In the unlikely event of an unusual economic situation which would cause a drastic change in the cost of operating a charter trip, such as war or oil embargo, or other unusual circumstance, the company reserves the right to adjust the previously agreed upon price accordingly, b) if the price of diesel fuel increases by more than fifteen cents ($.15) per gallon between the date of the contract and the date of the charter, the company may charge a fuel surcharge.
Full payment is due 10 days in advance of your trip. Payment may be made by check, cashier’s check /money order, cash, or credit card (call for cards we currently accept).
SECURITY DEPOSIT: When the nature of the charter trip is such that the company is required to expend a greater than normal amount of time and materials necessary to clean the equipment properly upon its return to the garage following the charter trip, the company, at its option may require additional costs to cover such additional time and materials.
TIMES: The time of arrival at starting point, stop-over point, destination or return to point of origin cannot be guaranteed. Travel speed limits are prescribed by law and drivers are instructed to travel at all times at speeds compatible with safe operation. Road, traffic and weather conditions are beyond the control of Flagship Trailways and its employees and no refunds shall be given as a result of late arrivals due to such conditions or other occurrences out of the control of the company.
